| Dan represents various parties in all manner of distressed financial situations, both in and out of bankruptcy and state court. His experience includes representation of debtors, debtor-in-possession lenders, creditors' committees and secured creditors in Chapter 11 cases and trustees in Chapter 7 cases. He represents purchasers and sellers of distressed assets, including stalking-horse bidders. He has also conducted loan workouts and represented companies in corporate restructuring.
Dan has litigated numerous bankruptcy cases and matters involving preferences and fraudulent transfers. He has experience trying cases including nondischargability, relief from automatic stay, public trustee and judicial foreclosures and fiduciary duty involving officers and directors of insolvent companies.
Dan has extensive experience assisting borrowers and lenders with insolvency issues related to structured finance transactions, particularly with respect to nonconsolidation opinions. |
