Eric Berg

Eric is a Shareholder in the Santa Barbara and Los Angeles office of Brownstein Hyatt Farber Schreck and a member of the firm’s Litigation Group.

Eric has over 20 years of experience focusing on complex commercial and real estate litigation. Representing clients in state and federal courts across the country, he has achieved successful trial results across all major industries, including private equity, banking, financial services, energy and commercial property.

Eric's commercial litigation experience includes representing private equity clients in both outside litigation and internal investigation matters. He represents public and private companies, as well as their officers and directors, in shareholder derivative actions in both state and federal court. Eric has a long history of successfully representing financial services clients in FINRA investigations and disputes, as well as representing closely held companies in a large variety of commercial matters.

Eric's real estate experience includes the representation of California property owners in high profile and complex coastal access disputes with the state. Mr Berg also successfully defended a nationally chartered financial institution in wrongful foreclosure litigation, and has represented commercial property owners in land use, contract and disclosure matters.

Eric serves as an Arbitrator for both the State Bar of California’s Mandatory Fee Arbitration Program and a similar program administered by the Santa Barbara County Bar Association.

In 2008, Eric was elected to membership in the American Board of Trial Advocates, an invitation-only national trial lawyer organization. 

Representative Matters

Represented a public utility district in federal district court to acquire property and water rights for use by the district for its recycled water operations. The district required additional property and water rights for use in conjunction with land application of recycled water from its wastewater operations and for recreational and agricultural purposes.
Represented Ramirez Canyon Preservation Fund relative to Santa Monica Mountain Conservancy's unlawful use of property in Ramirez Canyon in Malibu, California.
Brownstein represented a water and sewer district in the condemnation of 1,400 acres of land and 2,300 acre-feet of surface water rights on a river for use in connection with the district's recycled water operations. Condemation was commenced in Federal Court after pre-condemnation negotiations did not result in an amicable pruchase.
