Susan P. Klopman

Susan represents employers in state and federal court and before administrative agencies in all facets of employment law.

Susan has significant trial experience, including a defense jury verdict on breach of “fair treatment” handbook policies and marital status discrimination, among other success enforcing and defending trade secrets and non-compete claims. She also counsels on matters related to ADA, ADEA, Title VII, FLSA, FMLA, the Colorado Anti-Discrimination Act (including lawful off-duty conduct claims), the Colorado Wage Act, and drug and alcohol testing regulations, among others. Susan also has experience in handling matters in front of the Equal Employment Opportunity Commission (EEOC). In particular, Susan advises clients on Title I and Title III of the ADA, including compliance with U.S. Department of Transportation regulations for motor carriers, U.S. Department of Justice regulations for public accommodations, and EEOC regulations for employers. Susan also represents employee welfare and pension benefit plans and administrators in actions brought pursuant to the Employee Retirement Income Security Act of 1974, as amended (ERISA). 

Susan has authored several articles on various areas of employment law and has taught a continuing legal education seminar on association claims under Title VII and the ADA. She also serves as co-chair of the firm’s Inclusiveness and Diversity Committee.

Representative Matters

Represented Global Employment Solutions, Inc. in the sale of its professional employer organization business division to a financial buyer.
Represented the Law School Admission Council (LSAC) in an American Disabilities Act challenge involving test administering.  Brownstein handled the case and emergency appeal before the 10th Circuit.
Represented a sporting venue/event center in a Title III challenge under the American Disabilities Act.
Serves as employment counsel for various large regional companies in industries ranging from aviation, energy and engineering/construction to food service, health care, retail and telecommunications. Brownstein provides both pro-active counsel and litigation services for these companies.
Represented a large utility provider in a case involving multi-plaintiff discrimination claims.  Brownstein obtained judgment in favor of the client as a matter of law.  The Tenth Circuit, on appeal of the District Court's ruling, issued a published opinion regarding the lawfulness of our client's actions and hiring processes in particular.
