Environmental & Remediation |
A problem-solving approach to the world of environmental compliance
Brownstein Hyatt Farber Schreck's Environmental & Remediation Group is a leader in the ever-evolving field of environmental law. Our Group members bring considerable experience to bear on assessment, corporate compliance and litigation work relating to environmental issues, land cleanup and natural resource protection. We employ a sophisticated, collaborative approach to environmental compliance that focuses on our clients' business objectives while identifying strategies for minimizing environmental exposure.
We do work for clients nationwide on virtually every aspect of environmental law. Our environmental law expertise includes solid and hazardous waste, development of Brownfield sites, Superfund liability, water and air quality, underground storage tanks, protection of endangered species, and advice concerning legislative and rulemaking developments in the environmental arena. With an average of nearly 23 years of experience in the environmental field, our shareholders have the experience and knowledge to provide invaluable assistance in the most complex transactional, regulatory or litigation matter.
Members of our Group have also worked for Congress and for federal and state agencies, including Congressional energy committees, the Departments of Energy and Interior, the Department of Justice, the Environmental Protection Agency and the Colorado State Attorney General's office. Because we have worked on environmental and remediation issues from within the government, we have a better understanding of the overall system, which helps us obtain the best possible results for our clients.
Services
Preventative Liability Identification. Effective environmental risk assessment and remediation involves spotlighting potential issues as far in advance as possible. We alert our clients to issues before they become problems, so that they can more effectively manage their liability.
Remediation. The Environmental & Remediation Group works on matters involving the removal of pollution from soil, ground water, sediment and surface water, as well as issues surrounding Brownfield sites intended for redevelopment.
Environmental Contamination Due Diligence. Our remediation attorneys perform due diligence on environmental contamination issues and conduct environmental reviews for properties included in real estate transactions.
Environmental Litigation. When litigation arises, we have considerable experience tackling issues related to environmental remediation and compliance. We have repeatedly and successfully litigated on behalf of clients facing potential criminal and civil violations of CERCLA, RCRA, the Clean Water Act, the Clean Air Act, the Endangered Species Act and other environmental statutes.
Environmental Permitting. On behalf of utility providers, resort developers, ski areas, home builders, telecommunications companies and highway authorities, our team analyzes permitting strategies and assists in obtaining permits from the U.S. Army Corps of Engineers, Fish & Wildlife Services, the EPA, the Bureau of Land Management, state water resource and environmental agencies, and city and county governments.
