Tailored solutions for 21st Century progress
Land use can be a tricky, many-faceted area of the law, and few firms are better equipped to deal with it than Brownstein Hyatt Farber Schreck. Our experienced Land Use Group regularly works on complex development projects that address zoning, environmental, transportation, economic, cultural and community issues. Representing developers, corporations, lending institutions, manufacturers, municipalities, ski areas, retail operations and property buyers, we deal with the intertwining concerns brought up by real estate development and redevelopment, engineering and construction, water rights, remediation and other land use issues.
The group negotiates public-private agreements for major development projects, such as sports stadiums, large and small shopping centers and infrastructure developments. These agreements cover the provision of utilities, tax increment or other public financing, establishment of special districts and other complex matters. We also assist in drafting and negotiating annexation and development agreements. Problem projects are no problem for us, as we are well accustomed to working with condemned property and contaminated areas.
When necessary, the group conducts land use litigation, principally representing landowners and developers whose development applications were denied or whose development rights were impaired through municipal action. We also represent developers before planning commissions and municipal boards on applications for annexation, rezoning, planned developments and subdivision approvals.
The Brownstein Advantage
- Service that extends above and beyond. Land use matters often involve more than strict legal work. Our attorneys regularly work with municipalities, neighborhoods and civic groups to develop consensus and negotiate productive deals. In the end, it’s all about helping you reach your goals in a productive, forward-thinking way.
- Public sector experience. Many of our attorneys have worked in the top levels of local, state and federal governments. They interact regularly with governmental agencies and are intimately familiar with the laws and regulations. More importantly, they use their experience to identify emerging trends, regulations and laws that may affect your interests.
- Problem solving capabilities. We are all about solving problems so our clients can move forward with their ventures. Part of that work involves identifying and avoiding potential pitfalls so everything remains on track. With our public sector experience, we bring additional perspectives that help us navigate small bumps in the road before they become roadblocks.
- Industry relationships that benefit the client. Our Land Use attorneys have strong ties in the communities we serve. We are used to liaising between municipalities and developers. We have practitioners with land use planning backgrounds and public policy experience. We can act as translators who help get all parties speaking the same language and working toward the same goals.
- Public finance lobbying. These days, every new project requires massive investments in public infrastructure. This, in turn, necessitates significant public financing. We are adept at helping clients obtain this funding. We coordinate with our Government Relations Group to lobby governments and make sure the money is available to get the project off the ground.
- Jumping through hoops for approval. Our lawyers don’t miss a detail when it comes to securing approvals for our clients. We work with state and local authorities to obtain zoning approvals, site plan reviews, architectural reviews, environmental permits, DOT approvals, building permits and everything else required.
- Narrow focus but broad perspective. We work in a small niche of real estate law, but we employ a vast array of tools. We regularly call on our Development, Engineering & Construction, Water and Remediation groups, as well as resources within our Government Relations practice. Together, we can tackle any problem that arises during a large, complicated development project.
