Law & Water Column, American Water Works Association Journal, July 2009

Attorneys in Brownstein's Water Group author the monthly "Law & Water" column in the American Water Works Association Journal. Each column provides valuable legal insight in the form of case summaries of interest to water utilities across the U.S.

July's column discusses the Colorado Supreme Court ruling that when water storage rights decrees are silent, the state and division engineers have authority to impose a fixed water year on water storage rights for purposes of administering the state's one-annual-fill limitation.

The column also discusses the ruling that coal-bed methane producers must obtain well permits and may require a water court-approved plan for augmentation.
