Beginning January 1, 2011, flex spending accounts, HSAs and other health care accounts cannot be used for non-prescription over-the-counter drug purchases. In addition, debit cards cannot be used to purchase these drugs. This Client Alert summarizes the new law and related IRS guidance and identifies some important employer action items.
