On February 2, 2010, the Securities and Exchange Commission ("SEC") published interpretive guidance to assist public companies in determining whether disclosure is necessary and, if so, what to disclose, with respect to the impact that climate change may have on their businesses under the SEC's existing disclosure requirements. The SEC's new guidance technically does not create new legal requirements or modify existing ones. What it does do is clearly outline the requirements and methodology to be employed to address climate change in public company disclosures going forward.
