When it comes to regulatory compliance, Emily Renwick Garnett has the public policy background, litigation skills and consumer protection insights necessary to help companies and individuals navigate applicable regulations and defend them in state and federal investigations.

Emily has a wide-range of expertise including advising virtual currency businesses, fin-tech companies, collection firms, and hospitality companies on state by state licensing requirements and federal regulatory issues. Emily’s practice also includes performing mock audits, conducting company trainings and designing compliance protocols and procedures for public and private companies.

Emily also conducts internal investigations on behalf of public and private companies and provides comprehensive counsel to help clients avoid litigation by advising them on their compliance strategies.

Emily’s practice regularly brings her into federal and state court, including cases before  the U.S. Securities and Exchange Commission, the Department of Justice and the Colorado Attorney General.

Emily’s public policy background, including working on the legislative draft of the Dodd-Frank Act, and active role in state party politics, positions her to provide insight on the relationship between litigation matters and financial regulations.

Representative Matters
  • Advise CoinLion in its compliance, licensing, and consumer-facing materials. Coinlion is a trading and portfolio management platform that allows users to easily and efficiently manage and trade cryptocurrency. There are over 1,500 different cryptocurrencies with more emerging every day. Coinlion is the world's first cryptocurrency trading platform with built-in portfolio management, social integration, and token incentivization.

  • Ongoing representation of public company executive alleged to have committed securities fraud and other related claims, facing criminal and civil exposure.

  • Successfully obtained dismissal with prejudice of consumer protection and wrongful foreclosure claims brought against law firm on the basis of res judicata and statutory immunity.

  • Successfully resolved major class action lawsuit against law firm for alleged violations of the Fair Debt Collection Practices Act on favorable class notice and payment terms.

  • Played a critical role in obtaining dismissal of claims arising from public company's merger disclosures without making any additional disclosures or paying a settlement to plaintiffs. This litigation outcome sets a benchmark for other merger "strike suits" and will help ensure that this client and future public companies are not liable to future nuisance suits.

  • Represented hospitality company in litigation suit alleging fraud and other common law claims regarding the location of the certain utility lines. Negotiated a walk-away settlement for client.

  • Defended and successfully resolved product liability litigation on behalf of agriculture product manufacturer.

  • Developed and conducted a consumer protection audit for public hospitality company in the time-share market. The audit entailed reviewing every consumer-facing aspect of the company’s business including its compliance with state and federal consumer protection laws. Following the audit, conducted multiple training sessions for all of the company’s consumer-facing employees and management.

  • Designed and conducted due diligence on behalf of venture capital fund that specializes in the educational fin tech space. Also advised client on compliance with state and federal consumer protection laws and regulations.

  • Developed and conducted a consumer protection audit for a for-profit education company specializing in technology and coding bootcamps. The audit entailed reviewing every consumer-facing aspect of the company’s business including its compliance with state and federal consumer protection laws. Following the audit, conducted multiple training sessions for all of the company’s consumer-facing employees and management.

  • Successfully defended third-party executive in deposition in connection with a property casualty suit. Successfully negotiated to keep client from being named as a party in instant or subsequent litigation.

  • Defended satellite imagery public company in million dollar breach of contract dispute with former consultant. Resolved on highly favorable terms to client.

  • Successfully represented one of the largest health insurance companies in the country in a lawsuit alleging violations of the Sherman Act and Colorado Antitrust Act. Asserted counterclaims under the Sherman Act, Colorado Antitrust Act, Colorado Consumer Protection Act, and ERISA, in addition to various tort claims.

  • Successfully represented former in house counsel in SEC inquiry and avoided need for client to testify.

  • nternal investigation for public company of alleged wrongdoing reported in whistleblower complaint. Resolved inquiry under budget and within two weeks of engagement.

  • Represented a client in matters concerning alleged violations of consumer protection and fair debt collection laws, in additional to private contract and tort claimes.

  • Represented a law firm in defense of a federal class action alleging claims under the federal Fair Debt Collection Practices Act.

  • Successfully resolved breach dispute for public company that operates over 1,000 retail locations.

  • Represented client in landlord tenant dispute and complex condemnation proceeding in both state and federal proceedings.

  • Represented client in putative class action lawsuit regarding disputed foreclosure practices and alleged violations of the Colorado Consumer Protection Act, the Fair Debt Collection Practices Act, and the Colorado Antitrust Act.

  • Represented client in litigation in disputed foreclosure action, asserting claims of breach of contract, violations of the Colorado Consumer Protect Act, the Fair Debt Collection Practices Act, intentional infliction of emotional distress, and civil conspiracy
