Hughes, Van Aaron

Aaron Hughes is a multi-faceted commercial litigator. His broad practice encompasses appellate advocacy, antitrust, securities fraud, contract disputes, and intellectual property litigation. Aaron coordinates all aspects of complex litigation for clients, from initial analysis and planning, to discovery, motions, hearing, trial preparation and civil trials.

In more than two decades practicing law in Colorado, Aaron has prepared winning briefs to the U.S. Supreme Court and the Colorado Supreme Court, and has successfully led and tried numerous civil litigation matters. He has also had the privilege of arguing before the U.S. Supreme Court.

A frequent author, Aaron has published articles in Employment & Labor Relations Law and Securities News. His considerable writing skills extend beyond briefs and legal commentary. He is a fiction author with 10 published short stories to his credit, as well as a book reviewer and interviewer.

Representative Matters
  • In a two week trial, successfully defended a major brokerage and investment bank against securities fraud claims asserted by purchasers of millions of dollars of municipal bonds. The plaintiffs alleged under the Colorado Securities Act that defendants made material misrepresentations and omissions in connection with the sale of the bonds, and that our client could not show that it exercised appropriate due diligence according to the standard of care. The judge rejected the plaintiffs’ claims and concluded that our client satisfied the standard of care for a municipal underwriter of securities and that the alleged misrepresentation most strongly contested at trial was not material.

  • Successfully defended clients in Securities Exchange Act Section 16(b) short swing profits case. All Claims dismissed by US District Court judge on motion to dismiss.

  • Represented the leader in automated digital ad insertion for cable industry in a software trade secrets case in the Southern District of New York through a multi-week preliminary injunction proceeding resulting in a complete cessation of the competitor’s business.
