The Infrastructure Group provides counsel, lobbying and strategic advice for transportation project development and financing initiatives across every aspect of the industry. Our long-standing relationships with the transportation agency managers and policymakers throughout the Rocky Mountain west and southern California allow us to advance major project initiatives on every front. In Washington, D.C., we have successfully helped municipalities and companies identify funding sources and created new opportunities for federal assistance.

Our attorneys have worked for and facilitated transportation projects across the entire industry realm, from bridge and highway to airport expansion and port infrastructure improvements.

Our work includes public highway and light rail development in the Colorado Front Range, principal counsel for the design-build development of the Denver beltway corridor and its most recently completed highway and light rail improvements, representation of builders and contractors for major highway improvements in New Mexico and Kansas, lead counsel for the expansion of McCarron International Airport in Las Vegas, lead counsel for private design-build contractor developments at Denver International Airport, representation of the Port of Long Beach and the Port of Los Angeles, and representing clients in Washington, D.C., before Congress and executive branch agencies.

Infrastructure Group members include former city attorneys, state attorneys general, federal agency counsel, lobbyists and advisors to developers for a wide range of transportation infrastructure projects.

  • Represented Marana Aerospace Solutions, an aviation MRO service provider and a portfolio company of Monroe Capital, in its purchase of Ascent Aviation Services, another aviation MRO service provider, from LongueVue Capital Partners.

  • Brownstein successfully pursued a policy both legislatively and administratively that clarified DOT policy on funding issues regarding airport roads. This was a major victory for a major airport and will save the facility millions of dollars in unnecessary spending.

  • Represented major airline before state attorneys general on industry merger.

  • On behalf of a large, multi-modal transportation agency, advocated for significant reforms to the federal funding process for transportation projects that ultimately were included in surface transportation reauthorization legislation.

  • Served as special Nevada counsel to Southwest Airlines Co. in its acquisition of AirTran Holdings Inc. valued in excess of $1 billion.

  • Represented Orange County toll road agency in seeking State and Federal Coastal permits to complete construction of State Route 241.

  • Represented the construction contractors on the $1.8 billion TREX highway and light rail expansion project along I-25 in Denver, the largest public works project in the history of the region. Brownstein's representation included contract negotiation, contract dispute resolution advice and adjudication, regulatory compliance advice, and regulatory compliance defense, both administrative proceedings and litigation, for the transportation project.

  • Served as counsel to BNSF Logistics, LLC on the acquisition of stock of Texas-based third-party transportation logistics/import-export brokerage companies Diversified Freight Logistics, Inc. and Royal Cargo Lines.

  • Represented Burlington Northern Santa Fe Corporation in various sale and joint venture transactions to build technology platform to meet Congressionally mandated requirements for the rail industry to implement Positive Train Control.

  • Brownstein has represented the FedEx Corporation for the last several years and has successfully navigated this global company through the challenges associated with travel through the I-70 corridor, state regulations on the heavy trucking industry issues from legislative and regulatory perspectives, and fleet negotiations. Through negotiations with the Executive Director of the Colorado Department of Labor and Employment and her policy team, we have negotiated resolution of independent contractor/employee misclassification issues and established workable and reasonable DOLE internal audit guidelines.
