Sustainable. Renewable. Green. Whatever name you choose to assign, industry leaders know that creating new spaces—or maintaining old ones—requires a new way of thinking. No longer just fashionable, green building has become good business policy. Local, state and federal regulations are proliferating and consumers now demand sustainability. From construction of new communities to retrofitting existing structures to creating lease agreements that fit today's business requirements to land conservation, new rules are in play.

The attorneys and consultants in Brownstein's Green Building practice work with policy makers and regulators, landlords and tenants, and cutting edge non-profit and industry groups. We are involved in the conversations that shape standards and incentives. We counsel corporations, organizations and individuals on green initiates related to public policy, land use and zoning, energy, renewable energy, water, air quality, environmental regulation, corporate operations, real estate and climate change.

Our Green Building Group is led by three LEED AP attorneys who have been at the forefront of green building since its evolution into the modern vernacular, working on major developments throughout the west. Members of our natural resources, renewable energy and corporate groups contribute their experience to our work in the green building arena, adding a cross-practice approach. We are thoroughly familiar with all of the regulations, standards and criteria related to energy efficiency and green building, including USGBC/LEED, Energy Star, Green Globes, BOMA Energy Efficient Program (BEEP) and others.

Representative Matters
  • Counsel to MOXI, The Wolf Museum of Exploration + Innovation on real estate, land use, redevelopment and CEQA issues associated with the construction of a 17,000 square foot museum designed to LEED Silver standards in the City of Santa Barbara's downtown El Pueblo Viejo Landmark District.

  • Represented Public Service Company of Colorado, an Xcel Energy company, in connection with the design, construction and leasing of a new 400,000 square foot office building for its new regional headquarters. Designed with a LEED-CS Platinum-certified shell, it is the first LEED Platinum high-rise office building in the country.

  • On behalf of several different casino and hotel owners for a variety of large projects throughout Las Vegas, performed transactional risk assessment and mitigation recommendations; handled all aspects of permitting; advised regarding environmental issues; made recommendations regarding on-site and off-site renewable and alternative energy facilities and power purchases; handled regulatory and all matters related to LEED Certification.

  • Handle ongoing constraints and opportunities analysis for a 4,000-acre ranch in coastal Santa Barbara County related to land use, agricultural and natural resources planning. Brownstein is also coordinating related entitlements for two single-family residences and managing the process for LEED for Homes certification.

  • Brownstein processed entitlements for green, low-impact, modular home designed by Los Angeles-based Marmol Radziner in a coastal Santa Barbara community.

  • Represented a client before Santa Barbara County to obtain entitlements for the development of a custom-designed, sustainable home. Brownstein also assisted in easement issues and managed the LEED certification process for the property.
