We assist all providers with the real estate and facilities development, operational support, government relations advocacy, corporate guidance, charitable and property tax matters, hospitality programs, health care licensing, employee relations, and compliance requirements needed by the senior living community.

Our attorneys and policy professionals have deep relationships with the developers, operators, financiers, service providers, and governmental bodies who are at the heart of the senior living industry. We meet and resolve challenges in the boardroom, in community workrooms, in architects’ studios, in banks and private equity firms, in front of state agencies and legislatures, before Congress, and in the courtroom.

We have the capability and capacity to serve clients with expansion plans throughout the country, and particularly in the Mountain West and California.

Representative Matters
  • Represented borrower on a construction loan for an age-qualified apartment community in Littleton, CO.

  • Assist critical access hospitals, physician practices and senior living facilities to clarify and reduce liability for billing practices errors through voluntary overpayment OIG protocol.

  • Serves as land use counsel for Casa Dorinda, a Southern California 360-resident retirement community, which secured approval for an update of its campus master plan. The update includes new cottages and other independent living units, an enlarged personal care facility, and a new memory care unit. Brownstein assisted the client in successfully negotiating settlements with a number of neighbors who had concerns about the intensification of use on the campus.

  • Counsel to MBK Senior Living on Medicare and Medicaid issues, adult day care services, compliance, and PACE (Program of All-Inclusive Care) services.

  • Represented Atria Senior Living Group Inc. in a deal to merge its real estate interests with the Ventas Inc. real estate investment trust. Brownstein's representation included the analysis of and advice concerning state and local licensing requirements for assisted living and senior living facilities in Colorado, Utah, New Mexico and Nevada; a legal opinion regarding certain transactions affecting facilities in New Mexico; and research and preparation of applications for several ancillary licenses in some of the states, including interfacing with state health officials.

  • Represented Valle Verde, a 250-unit continuing care retirement community in Santa Barbara, CA, owned by American Baptist Homes of the West, with respect to a proposed updating of its facilities, including expanding the number of independent living units and scope of resident services.
