Accommodation Delayed Is Accommodation Denied

In Strife v. Aldine Independent School District, a disabled veteran school employee requested the accommodation of bringing a service dog to work. The employee sought that accommodation in August 2022, and the employer responded the next month with are quest for additional information from the employee’s medical provider, which the provider supplied. The employer then asked the employee to provide information from an alternate provider, which the employee did in November 2022. The employer considered the second opinion insufficient and requested an independent medical review. After the employer rejected letters from two additional physicians in support of the accommodation request in January 2023, the employee brought suit in the U.S. District Court for the Southern District of Texas. Just prior to the preliminary injunction hearing, the employer approved the request.
