Marc Diamant thrives in the complex world of today’s commercial real estate transactions, which often cross borders and involve multiple parties and areas of the law. From large portfolio transactions to leasing negotiations with leading national companies, Marc’s practice focuses on transactions of varying size and complexity.

He has extensive experience negotiating complex leases for landlords and tenants, specifically for office, retail, mixed use and industrial projects.

  • Represented a local developer in negotiating a build-to-suit lease for a 60,000 square foot eating recovery center.
  • Represented a national health care provider in negotiating build-to-suit leases and other leasing matters.
  • Represented landlord in negotiating complex lease with family medical practice and subsequent sublease with a national health care provider.
  • Currently serving as lead real estate counsel for a national commercial real estate investment company for all of its Colorado assets; recently led acquisitions and dispositions of office and industrial projects for the company in Texas, Colorado and Washington.
  • Represented a leading developer in all aspects of the redevelopment of Colorado’s Southglenn Mall to create a new, mixed-use center, including the eminent domain process, public and private financing, creation of governing documents and leasing more than one million rentable square feet of retail, office and residential space.
  • Currently serving as real estate counsel for the firm, managing all leasing matters.

Marc represents clients in the acquisition and disposition of real estate assets throughout the United States, and has successfully negotiated complex transactions involving 200-500,000 square-foot shopping centers in various states.

Marc has also amassed experience advising corporate lenders in connection with financing work, including construction loans.

He is also licensed in Arizona.

Marc is fluent in German and Hebrew.

Portfolio Transactions

Marc frequently represents clients in transactions involving large real estate portfolios. Notable transactions include advising ACF Property Management, Inc. on the acquisition of multiple retail centers throughout the United States. 

Acquisition/Disposition

Marc counsels companies on the buying and selling of both commercial and residential real estate. Recent projects include advising clients on the purchase and sale of properties in Colorado, Florida, Nevada, California, North Carolina, Missouri, Ohio, Arizona, Kansas and Illinois. He has negotiated transactional documents for investment by multiple Israeli companies in U.S. investments. 

Lending

As counsel to lenders in commercial real estate transactions, Marc provides advice concerning the structure of real estate financing transactions such as asset-based loans, construction loans, security agreements, projects financing, loan restructures and workouts, letters of credit and other matters. Recently, he represented a national lender in connection with a $30 million construction loan.

  • Represented Alberta Development Partners, LLC in all aspects of redevelopment of Southglenn Mall to create a new, mixed-use center called The Streets at SouthGlenn, including the eminent domain process, public and private financing, creation of governing documents with Sears and Macy's and leasing of more than one million rentable square feet of retail, office and residential space to national and regional retailers such as Whole Foods, Dick's Sporting Goods, Best Buy, Staples, 24 Hour Fitness, Ross and eCollege.

  • Represented Alberta Development Partners, LLC in the development and financing of Cornerstar, a new mixed-use center containing 158 acres of retail and residential space in Aurora, Colorado. Brownstein handled the leasing and selling of portions of the center to national and regional retailers such as Target, Dick's Sporting Goods, Best Buy, Office Depot, 24 Hour Fitness and Sunflower Market.

  • Represented Writer Square 08 A, LLC in the acquisition of Writer Square, a mixed-use retail and office property located in downtown Denver.

  • Represented CCA, Inc., a holding company which owns and operates a network of radio stations, in the refinance of a multi-million dollar term loan with United Western Bank.

  • Represented Shea Homes Limited Partnership in the acquisition of various real estate assets and entity interests related to the development of both commercial and residential property in Denver and Arapahoe Counties.
