David Meschke helps clients avert crisis through his complex commercial litigation practice. He leads high-stakes commercial matters and is known for his exceptional writing, analytical and research skills. David has defended clients in cases involving real estate and land use disputes, breach of contract, securities law, antitrust, class actions and special district litigation. He has tried multiple cases in Colorado and New Mexico, argued before both the U.S. Court of Appeals for the Tenth Circuit and the Colorado Court of Appeals, and is a co-chair of the firm’s appellate practice. He also draws from his experience working as a law clerk/judicial assistant to Colorado Supreme Court Justice Brian D. Boatright.
David also assists clients with statewide and local citizen-initiated ballot measures, advocating before the State Title Board and leading Brownstein’s Colorado Ballot Initiative Tracker, a comprehensive guide to proposed measures at the state level. Through this work, David finds clients creative solutions to address their litigation and policy needs.
Deeply committed to pro bono service, David has advanced issues related to education, civil rights and immigration. He has represented children in protection order cases, refugees seeking permanent residency and religious organizations challenging discriminatory restrictions.
David’s leadership extends beyond his legal work. He serves on the Executive Committee of the Colorado Lawyers Committee and co-chairs its Education Task Force. He also co-chairs the board of directors for New Legacy Charter School, which supports teen parents and their children. David further gives back by teaching intersession trial advocacy at the University of Colorado law school.
Representative Matters
- In a two week trial, successfully defended a major brokerage and investment bank against securities fraud claims asserted by purchasers of millions of dollars of municipal bonds. The plaintiffs alleged under the Colorado Securities Act that defendants made material misrepresentations and omissions in connection with the sale of the bonds, and that our client could not show that it exercised appropriate due diligence according to the standard of care. The judge rejected the plaintiffs’ claims and concluded that our client satisfied the standard of care for a municipal underwriter of securities and that the alleged misrepresentation most strongly contested at trial was not material.
