Construction
Providing unparalleled construction legal services
With extensive experience counseling multifamily, commercial, hospitality and industrial developers, as well as special districts and construction professionals on public and private projects nationwide, our team offers guidance through the entire lifespan of a development project. Whether negotiating a complex contract, ensuring compliance with public bidding requirements or representing a client in a trial or arbitration, Brownstein is invested in the success of every client.
Clients turn to our construction group for support in every phase of projects—from drafting and negotiating design, construction, professional services and public works contracts, to providing real-time advice during construction, to resolving project disputes. We guide clients through the process and strategy for selecting construction professionals on public works projects and represent clients in the enforcement of public works contracts, warranty obligations and bonds.
If a dispute does arise, we have a deep bench of trial-ready lawyers who have successfully resolved a broad range of disputes, including those involving property acquisition, brokerage services, public procurement, delays, construction and design defects, contract close-out, mechanic’s liens, landlords/tenants and subsequent purchasers. As sophisticated negotiators and relentless advocates for clients navigating mediation, arbitration and litigation proceedings, we understand the complexities of design and construction disputes, including potential reputational and relational impacts. We also routinely collaborate with the firm’s Real Estate Department to support developers and owners in the acquisition of property and beyond.
Facilitating Development of the Nation’s First “Carbon-Positive” Hotel
When Urban Villages decided to make Denver home to the first “carbon-positive” hotel in the nation, they knew it would be a challenge. That’s why our Real Estate and Construction teams were brought in to make this dream a reality. From negotiating the acquisition of the city-owned land; navigating entitlements, variances and transferrable development rights; securing construction financing; negotiating design and construction contracts; and advising on change of scope during construction, our team made the process as smooth as possible for Urban Villages. Set to be completed in 2024, the aspen tree-inspired design of the 13-story Populus Hotel will feature 265 guest rooms, a rooftop restaurant and bar, and retail and event space.
