The scope of regulation under the Clean Water Act has been in flux for well over a decade based on a fractured U.S. Supreme Court opinion, agency rulemakings and legal challenges to those rules. Most recently, Judge Martinez from the U.S. District Court for the District of Colorado stayed the recently promulgated Navigable Waters Protection Rule, the Trump Administration’s effort to reduce the scope of Clean Water Act jurisdiction.
