Design patents aren’t a replacement for the more common utility patents, though, said Benno Guggenheimer, an attorney at Brownstein Hyatt Farber Schreck’s Denver office. He said within the last few years, he’s seen his clients increasingly apply for utility patents to protect their inventions on e-commerce platforms.
